Terms of Service

These Terms of Service ("Terms") govern your use of the websites and services operated by Annseraf ("Annseraf," "we," "us"), a sole proprietorship based in Buffalo, New York, USA — including annseraf.com, Rent Your Compute (rentyourcompute.com), and VocalData (vocaldata.ai) (together, the "Services"). By creating an account or using the Services, you agree to these Terms.

1. The Services

Annseraf builds and operates software products. Rent Your Compute provides on-demand cloud infrastructure services billed by usage. VocalData provides voice and data AI software billed by subscription. Descriptions of each product, including how billing works, are available on the Products page and on each product's own site.

2. Accounts

  • You must provide accurate account information and keep it current.
  • You are responsible for activity that occurs under your account and for keeping your credentials secure.
  • You must be at least 18 years old and able to form a binding contract to use the Services.

3. Payment and billing

  • All prices are stated and charged in US dollars (USD).
  • Payments are processed by a PCI-compliant third-party payment processor. We do not store full card numbers. The payment processor's own terms and privacy policy apply to payment processing.
  • Usage-based services (Rent Your Compute) are billed for metered usage as described at purchase. Subscription services (VocalData) renew automatically each billing period until cancelled.
  • The exact price of any purchase or renewal is shown before you confirm it.
  • Refunds and cancellation are governed by our Refund & Cancellation Policy, which is part of these Terms.

4. Acceptable use

You may not use the Services to:

  • violate any law or the rights of others;
  • send spam, distribute malware, or conduct denial-of-service attacks;
  • attempt to gain unauthorized access to systems or data, including other customers' workloads;
  • mine cryptocurrency on compute resources unless the product's documentation expressly permits it;
  • process audio or data through VocalData that you do not have the legal right to process, including recordings made without consent where consent is required;
  • resell the Services in a way that misrepresents who operates them.

We may suspend or terminate accounts that violate this section, with notice where practicable.

5. Your content and data

You retain ownership of data and content you submit to the Services (workloads, audio, files). You grant us the limited rights needed to operate the Services — to store, process, and transmit your content as required to deliver what you've purchased. Our handling of personal data is described in the Privacy Policy.

6. Service availability

We aim for high availability but the Services are provided without a formal uptime guarantee unless one is stated in a separate written agreement. We may modify or discontinue features with reasonable notice; if we discontinue a paid service you have already paid for, you will receive a pro-rata refund for the unused portion.

7. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. AI-generated output (including VocalData transcripts and extractions) may contain errors and should be reviewed before being relied upon.

8. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, ANNSERAF'S TOTAL LIABILITY ARISING OUT OF OR RELATING TO THE SERVICES IS LIMITED TO THE AMOUNTS YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR GOODWILL. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

9. Indemnification

You agree to indemnify Annseraf against claims arising from your content, your use of the Services in violation of these Terms, or your violation of law or third-party rights.

10. Termination

You may close your account at any time. We may suspend or terminate your access for material breach of these Terms. Sections that by their nature should survive termination (including payment obligations, disclaimers, and limitations of liability) survive.

11. Changes to these Terms

We may update these Terms from time to time. Material changes will be announced by email or in-product notice at least 14 days before they take effect. Continued use of the Services after the effective date constitutes acceptance.

12. Governing law and disputes

These Terms are governed by the laws of the State of New York, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in Erie County, New York, and you consent to their jurisdiction.
